Rental terms and conditions
Last updated: October 14, 2026
These rental terms and conditions (the “Terms”) govern the rental of motorcycles and scooters offered by Malo’c Moto (the “Rental Company”) to any individual (the “Renter”), through its website or directly in store.
Any booking implies full acceptance of the Terms, which the Renter acknowledges having read before confirming the booking. The rental agreement signed when the vehicle is handed over supplements the Terms.
Purpose
The Terms set out the rights and obligations of the Rental Company and the Renter for the rental of a motorized two-wheeled vehicle, without a driver, for strictly personal use.
Rental requirements
To rent a vehicle, the Renter (and any declared additional rider) must meet the following requirements:
- Age: be at least 21 years old on the departure date.
- Licence: have held, for at least 2 year(s), a valid driving licence that is valid in France and appropriate for the category of the rented vehicle (AM, A1, A2, A or B as applicable).
- Documents to present: a valid ID card or passport, the original driving licence and, on request, proof of address dated within the last three months.
- Riders: only the persons named in the agreement are allowed to ride the vehicle.
The Rental Company reserves the right to refuse the rental if these requirements are not met or if the Renter appears unfit to ride.
Booking
A booking becomes firm once the Rental Company’s confirmation and, where applicable, the deposit payment have been received.
- The Renter guarantees that the information provided (identity, licence, contact details) is accurate.
- If the rental requirements are not met when the Renter arrives, the Rental Company may cancel the booking. Any amounts paid will then be refunded, except in the case of a false declaration.
- If the booked model is unavailable (breakdown, accident, late return), the Rental Company may offer a vehicle of an equivalent or higher category, or refund the amounts paid.
Prices and payment
Prices are shown in euros, including all taxes, and vary depending on the vehicle, the duration and the season. A deposit of 30% may be requested at booking; the balance is payable no later than when the vehicle is handed over. Payments are accepted by bank card or by the other means indicated on the website. Any rental day that has started is due in full.
Security deposit
A security deposit of €1000 per vehicle is required when the vehicle is handed over, by bank card pre-authorisation or by any other means accepted by the Rental Company.
This deposit does not limit the Renter’s liability. It is returned or released after the vehicle has been returned and inspected, less any amounts due (damage, excess, missing fuel, fines, cleaning fees, late return). The bank may take several days to release the funds.
Duration, pick-up and return
The rental runs from the handover of the vehicle to its return, on the dates and times set out in the agreement.
- The vehicle is handed over at the Rental Company’s address after the agreement is signed and a joint condition report is completed, with photos.
- The vehicle must be returned to the same place, on the agreed date and time, clean and in the condition recorded at departure, apart from normal wear and tear.
- A grace period of 30 minutes is allowed. Beyond that, any hour started may be charged and any extra day is charged at the current rate. In the event of a significant delay with no news from the Renter, the Rental Company may take the necessary steps, including reporting the vehicle as stolen.
- Any extension must be requested from and approved by the Rental Company before the end of the rental. No refund is given for an early return.
Mileage and fuel
The included mileage is 200 km per rental day. Each additional kilometre is charged at the rate communicated at booking. The vehicle is handed over with the fuel level recorded in the condition report and must be returned at the same level. Otherwise, the missing fuel is charged, plus a service fee. The Renter must use the fuel suited to the vehicle.
Equipment
Depending on the chosen offer, a helmet, gloves, a lock and other equipment may be lent. Wearing an approved helmet and approved gloves is mandatory, in accordance with the regulations in force. The Renter is responsible for the equipment entrusted to them; loss, theft or damage is charged at replacement value.
Use of the vehicle
The Renter undertakes to ride carefully, to comply with the traffic laws and to take care of the vehicle. It is strictly forbidden to:
- ride under the influence of alcohol, drugs or medication incompatible with riding;
- lend, sublet or entrust the vehicle to a rider not named in the agreement;
- take part in races, competitions, rallies, tests or demonstrations, or ride on a track;
- use the vehicle off public roads (trails, unpaved tracks, beaches);
- carry more passengers than the vehicle’s approval allows, tow, or transport goods for payment;
- leave mainland France without the Rental Company’s prior written consent;
- modify the vehicle, or tamper with the odometer or any mechanical part;
- leave the vehicle unattended without locking it and securing it with the lock, or leave the keys or documents on board.
Insurance and excess
The vehicles are covered by compulsory third-party liability insurance. Any additional cover (damage, theft) is set out in the agreement.
- In the event of covered damage or theft, the Renter remains liable for an excess of €1500 per claim, taken from the security deposit.
- The cover does not apply, and the Renter bears the full cost of the damage, in particular in cases of riding under the influence of alcohol or drugs, an unauthorised rider, prohibited use, gross negligence, loss of the keys or documents, theft with the keys left on the vehicle or the lock not used, or failure to report the incident within the required time.
- Certain items (tyres, accessories, equipment, keys) may be excluded from cover, as set out in the agreement.
Accident, breakdown or theft
In the event of an accident, breakdown or theft, the Renter must:
- ensure everyone’s safety and call the emergency services if necessary (112);
- notify the Rental Company immediately on +33 (0) 6 98 78 23 45;
- complete an accident report form if a third party is involved, or file a police report within 24 hours in the event of theft or vandalism, and give a copy to the Rental Company;
- not have any repairs carried out without the Rental Company’s prior approval.
In the event of a breakdown not caused by the Renter, the Rental Company will provide assistance and, where possible, a replacement vehicle. No compensation is due for the vehicle being out of service. Towing costs remain the Renter’s responsibility where the breakdown results from misuse.
Fines and offences
The Renter is solely responsible for any offences committed during the rental (speeding, parking, tolls, etc.) and for impound fees. The Rental Company is required to give the Renter’s identity to the authorities; an administrative fee may be charged for handling each offence.
Cancellation and withdrawal
The Renter may cancel their booking free of charge up to 48 hours before the departure time, and the deposit will then be refunded. After that time, or in the event of a no-show, the deposit is retained by the Rental Company.
Right of withdrawal: in accordance with Article L221-28 12° of the French Consumer Code, the right of withdrawal does not apply to vehicle rental services that must be provided on a specific date. The Renter is informed of this before confirming the booking.
The Rental Company may cancel the rental in the event of force majeure or if the vehicle is unavailable; any amounts paid will then be refunded in full.
Liability
The Rental Company is not liable for personal belongings forgotten, lost or stolen on board or in the vehicle’s storage compartments, nor for indirect damage (loss of holiday days, transport costs, etc.). This limitation does not apply in the event of personal injury or gross negligence by the Rental Company, and does not deprive the consumer of any statutory rights.
Personal data
The Renter’s personal data is processed in accordance with our privacy policy and the General Data Protection Regulation (GDPR). It may be passed to the authorities in the event of an offence and to insurers in the event of a claim.
Disputes and governing law
The Terms are governed by French law. In the event of a dispute, the Renter should first contact the Rental Company. In accordance with Articles L611-1 et seq. of the French Consumer Code, they may then use the following consumer mediator free of charge: À COMPLÉTER : nom, adresse et site du médiateur de la consommation.
If no amicable solution is reached, the competent courts are determined in accordance with the ordinary rules of law.
